5. Thermal and Moisture Protection
Wood floor is out of square.
Unsatisfactory quality of finished
interior trim and workmanship.
Interior trim is split.
Hammer marks visible on interior
trim.
Exposed nail heads in woodwork.
4.2 Finish Carpentry
Unsatisfactory quality of finished
exterior trim and workmanship.
5.1 Waterproofing
Leaks in basement or in
foundation/crawl space.
The diagonal of a triangle with
sides of 12-feet and 16-feet along
the edges of the floor shall be 20-
feet plus or minus 1/2-inch.
Joints between moldings
and adjacent surfaces that
exceed 1/8-inch in width are
deficiencies.
Splits, cracks, and checking
greater than 1/8-inch in width
are deficiencies.
Hammer marks on interior trim
shall not be readily visible from a
distance of 6 feet under normal
lighting conditions.
Setting nails and filling nail holes
are considered part of painting
and finishing. After painting or
finishing, nails and nail holes
shall not be readily visible from a
distance of 6 feet under normal
lighting conditions.
Joints between exterior trim
elements and siding or masonry,
which are in excess of 1/4-inch,
are deficiencies. In all cases,
the exterior trim abutting
masonry siding shall be capable
of performing its function to
exclude the elements.
Leaks resulting in actual trickling
of water through the walls or
seeping through the floor are
deficiencies.
Builder/Seller shall make necessary
modifications to any floor not
complying with the Construction
Performance Guidelines.
Repair defective joints and
touch up finish coating where
required to match as closely as
possible. Caulking is acceptable.
Builder/Seller will repair the
affected area to meet the
Construction Performance
Guideline, one time only
within the first year of Limited
Warranty coverage. Refinished
or replaced areas may not match
surrounding surfaces exactly.
Builder/Seller shall fill hammer
marks and refinish or replace
affected trim to meet the
Construction Performance
Guidelines. Refinished or
replaced areas may not match
surrounding areas exactly.
Fill nail holes where required
and if necessary, touch up paint,
stain, or varnish to match as
closely as possible.
Nail holes do not have to be
filled where the surface finish is
not conducive or so designed to
have nail holes filled because of
the product. Nail holes in base
and trim in unfinished rooms or
closets do not have to be filled.
Leaks caused by landscaping
improperly installed by You
or failure by You to maintain
proper grades are excluded
from Limited Warranty
coverage. Dampness in
basement and foundation
walls or in concrete basement
and crawl space floors is often
common to new construction
and is not a deficiency.
Repair open joints and touch
up finish coating where
required to match existing
as closely as possible. Caulk
open joints between dissimilar
materials.
Take such action as is necessary
to correct basement and crawl
space leaks, except where the
cause is determined to be the
result of Your negligence. Where
a sump pit has been installed
by Builder/Seller in the affected
area but the sump pump was
not contracted for or installed
by Builder/Seller, no action is
required until a properly sized
pump is installed by You in an
attempt to correct the condition.
Should the condition continue
to exist, then Builder/Seller shall
take necessary action to correct
the problem.
